पुनर्विलोकन और पुनरीक्षण में अन्तर-
पुनर्विलोकन और पुनरीक्षण में निम्नलिखित अन्तर है।
पुनर्विलोकन वही न्यायालय करता है जिसने निर्णय ( डिक्री या आदेश) दिया है, किन्तु पुनरीक्षण उच्च न्यायालय (उ0 प्र0 में जिला न्यायालय द्वारा भी ) किया जाता है।
उच्च न्यायालय द्वारा पुनरीक्षण उन्ही मामलों मे किया जा सकता है जिसमें उच्च न्यायालय को अपील नहीं होती किन्तु पुनर्विलोकन उन मामलों में भी हो सकता है जिनमें अपील उच्च न्यायालय को हो सकती है।
पुनर्विलोकन कोई भी न्यायालय कर सकता है, किन्तु पुनरीक्षण की अधिकारिता या शक्ति केवल उच्च न्यायालय को है।
पुनरीक्षण उच्च न्यायालय स्वप्रेरणा से भी कर सकता है, किन्तु पुनर्विलोकन के लिए दुःखी पक्षकार द्वारा आवेदन किया जाना आवश्यक है।
पुनर्विलोकन और पुनरीक्षण के आधार भिन्न - भिन्न है।
पुनर्विलोकन के बाद पारित आदेश के विरूद्ध अपील की जा सकती है किन्तु पुनरीक्षण के बाद पारित आदेश या डिक्री के विरूद्ध अपील नहीं की जा सकती है।
Following are the differences between review and revision.
1. Review is done by the same court which has given the decision (decree or order), but the review is done by the High Court (also by the District Court in Uttar Pradesh).
2.Revision can be done by the High Court in those cases in which there is no appeal to the High Court, but review can also take place in those cases in which the appeal lies to the High Court.
3. Review can be done by any court, but the jurisdiction or power of revision rests only with the High Court.
4. Revision can also be done by the High Court of its own motion, but for review, an application must be made by the aggrieved party.
5. The basis for review and revision is different.
6. An appeal can be made against the order passed after review but an appeal cannot lie against the order or decree passed after the review.
