मुजरा(set-off) एंव प्रतिदावा(Counterclaim) क्या है?
मुजरा(set-off) -
1. मुजरा का शाब्दिक अर्थ है दूसरे के विरूद्ध किया गया दावा । यह एक प्रकार से धन के लिए प्रतिदावा है।
2. ऋणों की पारास्परिक विमुक्ति को मुजरा कहते है।
3. यह बचाव का शुद्ध और सीधा तर्क है, जो समायोजन के द्वारा वादी के दावे को या तो समाप्त कर देगा या उसे कम कर देगा।
4.यह बचाव और प्रतिदावा दोनों का मिश्रण है। यह वादी के दावे के हद तक बचाव है और शेष के लिए प्रतिवादी द्वारा वाद में एक दावा है।

2. Mutual redemption of debts is called Mujra.
3. It is a pure and direct argument of the defence, which, by adjustment, would either nullify or nullify the plaintiff's claim.
4. It is a mixture of both defense and counterclaim. It is a defense to the extent of the plaintiff's claim and a claim in the suit by the defendant for the remainder.
प्रतिदावा(Counterclaim) -
वादी द्वारा मांगे गये अनुतोष को असफल करने के लिए प्रतिदावे के तर्क को प्रतिवादी ऊठा सकता है , लेकिन ऐसा प्रतिदावा केवल ऐसे अधिकार या दावे के सम्बन्ध में स्थगित कर सकता है जिसके लिए प्रतिवादी पृथक वाद संस्थित कर सकता है।
In order to fail the relief sought by the plaintiff, the defendant may set aside the argument for a counter-claim, but such counter-claim may only be adjourned in respect of such right or claim for which the defendant may institute a separate suit.
